Título : Reestatización del servicio de agua potable en el Área Metropolitana de Buenos Aires : aprendizaje de un estudio de caso (1993-2005)

Resumen : El propósito de este trabajo es entender el proceso que desencadenó la reestatización del servicio de agua potable del Área Metropolitana de Buenos Aires, a partir de la presentación de los hechos y el análisis de los factores, actores, y cuestiones que intervinieron. Se considerará que el punto de partida del proceso reside en el momento de la privatización del servicio que sentó un importante precedente para los hechos que vendrían, constituyendo de esta manera, hasta el fin de la convertibilidad dólar-peso, el primer momento o “nudo” de la política pública. El segundo momento se inicia con la demanda ante el Ciadi de las empresas proveedoras de servicios públicos hasta el primer acuerdo parcial de Aguas Argentinas con el presidente Kirchner. El tercer y último momento comienza con las protestas de las organizaciones de la sociedad civil en contra del Grupo Suez, dueño de Aguas Argentinas, en el contexto de las elecciones a legisladores nacionales, finalizando con la renegociación fallida que llevó a la reestatización del servicio. La relevancia del caso a estudiar consiste en la importancia de evaluar cuáles fueron las fallas en las que se incurrió en el control estatal, tanto en el diseño y en la implementación de la política pública como en el proceso de renegociación que condujeron al Estado a tomar el control del servicio público. Por lo tanto, el objetivo del trabajo es construir un aprendizaje de lo sucedido para poder mejorar el diseño e implementación de políticas públicas, particularmente relacionadas con la prestación de servicios públicos. El trabajo incluye un análisis del último momento del conflicto previo a la reestatización del servicio a partir de la teoría del dilema del prisionero para comprender las estrategias y motivaciones de los actores intervinientes que condujeron a la reestatización del servicio. The purpose of this thesis is to understand the process that triggered the re-nationalization of the water and sewage system in the Buenos Aires Metropolitan Area, by presenting the facts and analyzing the factors, actors, and issues involved. The starting point is considered to be the privatization of the service which actually set a very important precedent for the events to come, and thus becoming into the first moment of the public policy. The second moment starts with the claim of the public service companies to the ICSD until the first partial agreement of Aguas Argentinas with President Kirchner. The third and last moment starts with the demonstrations conducted by civil society organizations against the Suez Group, owner of Aguas Argentinas, by the time of the elections for seats in the parliament, ending with the failed renegotiation that lead to the re-nationalization of the service. The relevance of this case study consists of the importance of assessing which were the flaws incurred in the state control of the service, not only in the design and implementation of the public policy but also in the renegotiation process that lead to the national state to gain control of the public service. Therefore, the aim of this thesis is to learn from what happened so as to improve the design and implementation of public policies, particularly related to the provision of public services. The case study includes an analysis of the last moment of the conflict before the re-nationalization of the service with the prisoner’s dilemma, so as to better understand the motivations and strategies of the actors involved that lead to the re-nationalization of the public service.
